WISN.com Sports Pick Contest
Official Rules

1. No purchase necessary. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law. All federal, state, and local regulations apply. The WISN-TV WISN.com Sports Pick Contest (“Contest”) is sponsored by WISN-TV, UPickem, Potawatomi Bingo and Casino (collectively, “Sponsors”).

2. Eligibility. Contest is offered only to legal U.S. residents 21 years of age or older at the time of entry. Prizes are non-transferable by winners. Contest is offered only to Wisconsin residents who reside within the Milwaukee DMA as determined by Nielsen Media Research Services. Employees of Sponsors, The Douglas Group, Inc., WISN Hearst-Argyle Television, Inc., Hearst-Argyle Television, Inc., their parent, subsidiary, and affiliated companies, and their advertising or promotional agencies (collectively, the “Contest Entities”), and the immediate families or members of the same households of such individuals are not eligible. Proof of age, identity, and eligibility must be furnished to Sponsors upon request. All entry form information must be complete and accurate. Sponsors will not award a prize to anyone not meeting eligibility requirements at the time of entry. Sponsors reserve the right to disqualify any entrant if these Contest rules are not followed. By entering, you agree to comply with all applicable law and these Contest rules, and you agree to abide all decisions of the Sponsors. Contest is not offered or intended for gambling purposes. Entrants who use the Contest for gambling purposes are ineligible and will be disqualified and may be reported to appropriate authorities.

3. To Enter. The Contest entry period begins September 1, 2008. Entrants may enter the Contest by making picks up until fifteen (15) minutes before scheduled kickoff for each game. Picks may be made only for upcoming games; picks may not be entered retroactively. To enter, go to www.wisn.com. Enter your picks into the game fields for each scheduled football game. Following each week of the football season, entrants may enter their picks into the game fields for the next week of the season. Entrants do not predict all of the season’s game results at the start of the season. If you fail to make a pick for a particular game, the computer software will generate your pick by assigning you the most-picked team according to all other entries for that game. Entrants are not eligible to win a weekly prize unless they make all of their own picks for that week (i.e., entrants whose picks are generated by the computer software are ineligible to win weekly prizes in the weeks in which the picks are generated by the computer software). Entrants may participate in the Contest even after the football season begins but the chances of winning a prize for the overall season may be diminished. In order to be eligible to win the overall season prize, entrants must have made their own picks in at least eleven (11) of the weeks of the season (i.e., for an entrant to qualify to win the overall season prize, there must be at least eleven (11) weeks in which the entrant’s picks were not generated by the computer software). Sponsors do not acknowledge the receipt of entrants’ picks. Entries become property of Sponsors and will not be returned. Limit one entry per person. Sponsors are not responsible for entries that are lost, late, misdirected, incomplete, incomprehensible, illegible, damaged, undeliverable or delayed. Electronic and e-mail entries will be deemed to have been submitted by the authorized account holder of the e-mail address at the time of the entry. The authorized account holder is the person to whom the applicable internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address.

4. How to Win. There are two kinds of winners: weekly winners and overall season winners.

The point value for each game is clearly marked on the web page when entrants make their picks. Games are not all worth an equal amount of points. Each weekly winner is determined by the entrant who has the highest score for the week. The sum of an entrant’s best seventeen (17) weeks is the entrant’s total overall season score, and the entrant with the highest total overall season score is the overall season winner. Scores for each entrant’s worst four weeks are eliminated and do not count towards the entrant’s overall season score.

All decisions of the Sponsors are final.

If a game is canceled, forfeited, or indefinitely suspended for any reason, or if a game results in a tie, that game shall not count for any contestant and scores will be computed as if the game did not exist.

All results posted are unofficial until winners respond to notification.

Tiebreaking procedures. Ties are broken as follows:
For an individual week:
Entrants pick who they think is going to win each game along with the score for the designated tie-breaker game. The computer software then takes all the entries that are tied for most points for that week and applies the following calculations to the score of the designated tie-breaker game:
1. Subtracts what the entrant chose as the score for the winning team from the actual winning team’s score and squares this value.
2. Subtracts what the entrant chose as the score for the losing team from the actual losing team’s score and squares this value.
3. Adds 1 and 2 above together to get the entrant’s “score approximation.”
4. The entrant with the lowest “score approximation” wins the tie breaker for that week.
If there is still a tie after the application of the above, the computer software then randomly selects the weekly winner from all of those entrants who are tied.
As noted above, the top score from each week will be that week’s respective weekly winner. In the event that the top score constitutes more than one entrant, the tie-breaking procedures outlined above will be used to break the tie to reduce the top score to one winner for each week of the season in order to determine that week’s weekly winner.
For the overall season:
Each week entrants pick who they think is going to win each game along with the score of the tie-breaker game. The computer software then takes all the entries that are tied for most points for the overall season and applies the following calculations to the score of the final week’s tie-breaker game:
1. Subtracts what the entrant chose as the score for the winning team from the actual winning team’s score and squares this value.
2. Subtracts what the entrant chose as the score for the losing team from the actual losing team’s score and squares this value.
3. Adds 1 and 2 above together to get the entrant’s “score approximation.”
4. The entrant with the lowest “score approximation” wins the overall season tie breaker and is, therefore, the overall season winner.
If there is still a tie after the application of the above, the computer software then looks back at the previous week’s tie-breaker “score approximation” to determine which of the tied entrants’ previous week’s “score approximation” was lowest. If there is still a tie, the computer software goes back one more week and compares the tied entrants’ “score approximations” until the tie is broken. If there is still a tie after going back through all the weeks, the overall season winner will be determined by the computer software randomly selecting the winner from those entrants who are tied.

Prize winners will be notified by telephone and/or email, using the contact information provided in the winner’s entry. Sponsors are not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information. If Sponsors are unable, after seven (7) days, to contact a selected winner, or if that winner is unavailable for prize fulfillment, that winner will be disqualified and an alternate winner will be selected by application of the same scoring principles outlined above to the remaining entrants’ picks.

5. Prizes and Odds of Winning. Beginning October 7, 2008, each weekly winner at wisn.com Sports Picks Contest will win a $50 bonus play to Potawatomi Bingo and Casino. Weekly prizes have an approximate retail value of $50. Winners must redeem this prize within 4 weeks from the time they were notfied. Each week there will also be one UPickem’s national network-wide weekly winner and this winner will be awarded an official NFL watch from www.gametimeshop.com with a value up to $79.95 (entrants into WISN.com Sports Pick Contest are automatically eligible to compete for UPickem’s national network-wide weekly prize, subject to all the conditions and restrictions set forth in these rules).

The overall winner at WISN.com Sports Picks Contest will win the following prizes: 2 adult admission to Harley Davidson Museum ($32 value), one (1) night stay at Hyatt Regency in downtown Milwaukee at 333 West Kilbourn Avenue ($195 value), one play and stay voucher to Potawatomi Bingo Casino ($40 value) and one $50 certificate for travel at Rainbow Sky. Total value of prize for overall winner = $317. Some restrictions may apply. Weekly prizes awarded at wisn.com must be used by within 30 days of being notified. Grand prize must be used by May 31, 2009. Total value of overall winner prize is $317. The overall season winner for UPickem’s network-wide contest will win one (1) amazon.com $500 gift certificate (entrants into WISN.com Sports Pick Contest are automatically eligible to compete for UPickem’s national network-wide overall season prize, subject to all the conditions and restrictions set forth in these rules).

All charges, fees, and costs not specifically included in the prize descriptions above are the responsibility of the respective prize winner. Sponsors reserve the right to substitute prizes of equal or greater value in the event that the scheduled prize becomes unavailable. Odds of winning depend on the number of eligible entries received and on the relative ability of entrants to correctly predict the winners of games.

All weekly prizes will be mailed and must be redeemed within 30 days of notification. The grand prize must be claimed at the WISN-TV Studios, 759 North 19th Street, Milwaukee, Wisconsin 53233 no later than March 31, 2009. To claim grand prize, winners must provide a valid driver’s license or state identification card. Prizes not claimed by claim date will be forfeited.

6. Terms and Conditions; Limitation of Liability. Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Contest Rules, and by entering, participants agree to be bound to these Contest Rules. Any security breach or other attempt by an entrant or other party to tamper with the proper administration of the Contest will disqualify the entrant and may result in civil or criminal action against the entrant or other party and may result in the discontinuation, suspension, or cancellation of the Contest. Winners and entrants agree, except where prohibited by law, to release and discharge, hold harmless and indemnify the Contest Entities, their affiliates, suppliers, distributors, and advertising agencies and their employees, agents and representatives, shareholders, officers, directors, and their immediate families, successors and assigns, and all others associated with the development and execution of this Contest, from any and all tax liability that may be imposed or associated with receipt or use of the prizes, and from and against any and all claims, actions, proceedings, and liability of any kind whatsoever for any damages, expenses, fees, injury or losses (INCLUDING PERSONAL INJURY OR DEATH) sustained in connection with the receipt, ownership, or use of the prize or while traveling to, preparing for, or participating in any Contest-related or prize-related activity. By entering the Contest or by winning, participants grant to the Contest Entities the right to publicize the participant’s name, photograph, image, likeness, voice, statements, and biographical information for advertising, trade, and promotion purposes without compensation and without opportunity for review, except where prohibited by law. All winners must execute an affidavit of eligibility and liability and publicity release when claiming prize. Sponsors retain the discretion to make all decisions regarding the interpretation and application of these rules. All decisions of Sponsors are final and discretionary. The laws of the State of Wisconsin shall govern this Contest, without regard to Wisconsin’s choice of law rules. The courts of Wisconsin shall be the exclusive forum for any dispute relating to these Rules and/or this Contest. All participants and winners agree, by their participation in the Contest, to submit to the personal jurisdiction of the courts of Wisconsin. For prizes valued at $600 or greater, winner must provide his or her Social Security Number for tax purposes. Prizes may be considered income, and any and all taxes associated with prizes are responsibility of winner. The Contest and all of the related pages, contents and code are the property of and/or copyrighted by, UPICKEM.com, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted material, trademarks, or any other intellectual property without the express written consent of its owner is strictly prohibited.

7. Disclaimer and Force Majeure. Contest Entities, their affiliated, parent, and subsidiary companies, their employees, agents and officers, advertising and promotion agencies, and all others associated with the development and execution of this Contest are not responsible for: (1) problems associated with electricity, television transmission, radio transmission, cable transmission, satellite transmission, phone lines, facsimile, or cable lines and/or phone or IP numbers that are beyond their control—this includes, but is not limited to: a busy signal, operator interference, cellular interference, Internet congestion, sabotage, technical or atmospheric conditions that disrupt the completion of a phone call, facsimile transmission, email transmission, or cable modem service, or other Internet interruptions or malfunctions or for technical difficulties which may prohibit, prevent, or interfere with the transmission of television or radio signals to all or limited geographic areas during the playing of the Contest or that may prohibit, prevent, or interfere with the submission of an entry form; failures of or other problems relating to computer hardware, software, the Internet, or similar systems, including but not limited to difficulties relating to contestants’ ISP, DSL, or cable modem access, “worms,” or viruses; (2) typographical errors in any materials relating to the Contest; (3) lost, misdirected, illegible, incomplete, or delayed entry forms; (4) cancellations, postponements, or delays; (5) Acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or other similar causes beyond the control of the Contest Entities, their affiliated, parent, and subsidiary companies, advertising and promotional agencies and their immediate assigns, making it inadvisable, illegal, impossible, or impractical to continue the Contest or to perform under these Rules. Contest Entities make no warranty, guarantee, or representation of any kind concerning any prize, and Contest Entities specifically DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY.
